Art. 1: General considerations
These general terms and conditions are intended to define the rights and obligations of the parties under the online sale of goods proposed by Bricks For Kids to the user's of its e-commerce site.
Any order of products appearing in the online store Bricks For Kids.com requires consultation and prior acceptance of these general sales conditions. The click validating the order implies full acceptance of these general conditions of sale. The click has value of "digital signature".
Conditions apply throughout the duration of the online services.
The user placing an order or making a purchase on the site is deemed to be of adult age and responsible for his act of purchase.
c. Update of Sales Conditions
General Sales Conditions may be updated at any time without notice. Shall apply the general conditions of sale posted on the website at the time of use.
Art. 2: Order
User agrees that placing an order on the site is equivalent to the signing of a purchase order with all the ensuing consequences.
At each stage of the order, Bricks For Kids communicates with the user by e-mail to confirm the order and inform monitoring. These communications are at the email address provided by the user at the time of order. The user is responsible for the email address provided to Bricks For Kids. Bricks For Kids reserves the right to refuse an order or submit it to additional requirements that are then communicated to the user.
Art. 3: Products on sale
All the products presented on the site are described by Bricks For Kids with great care from the information available. Bricks For Kids is not liable if, despite all precautions, an error was inadvertently placed into a description or for any missing information. Images or visuals are not to be considered as contractual.
On each product description page is the status of the stock. The stock is carefully monitored by Bricks For Kids in real time. If, however, a product should be listed as available accidentally while out of stock, Bricks For Kids offer the user to opt for the cancellation of his order, or to purchase an alternative product, it 's understood without any compensation to the user.
The products offered are in accordance with Belgian and European legislation in force. The purchase of a product by a foreign user implies that it is informed about the product's compliance with the laws in force in his country.
Bricks For Kids can not be held responsible for misuse of products purchased on the website. Similarly, damage and / or injury resulting from misuse of the product are the responsibility of the user.
Art. 4: Price
The product prices include VAT (for EU countries) not included postage, packaging costs and expenses of preparing the order or any other indirect costs. The mentioned prices are subject to change at any time. These prices are subject to manifest encoding error. Orders that have been placed in these circumstances will therefore be automatically canceled.
Communities and business users can benefit from preferential rates. For this they are invited to contact Bricks For Kids.
Art. 5: Payment
The payment of orders placed on the site is via the secure payment platform Paypal or Ogone. Many electronic payment methods are offered:
Visa / Mastercard
Transactions on the site are secured by Paypal or Ogone payment system. All information exchanged to process the payment is encrypted using SSL. These data can not be detected, intercepted or used by third parties.
At no point in the transaction does Bricks For Kids take knowledge of banking information of the user. Bricks For Kids takes every mesure necessary to ensure that your purchases are made safely.
b. Bank Transfer
The user who does not wish to use an online payment method has the possibility to pay by bank transfer.
c. Payment by check
Bricks For Kids does not accept payment by check.
d. Payment Issues
Bricks For Kids reserves the right to refuse to honor an order from a user with whom a dispute is being administered.
Art. 6: Transport and delivery
a. Delivery procedures
Delivery methods available:
The mode of delivery "UNINSURED" means that the risk of transmission (loss, damage or theft) are the responsibility of the user.
The mode of delivery "INSURED" implies that the risk of the transport (loss, damage or theft) are borne by the seller.
If the recipient is not present or is unable to receive the parcel at first attempted delivery by the postal service, a second attempt will be made. If the second attempt proved inconclusive, the package will be made available to the recipient in the post office nearest to a period defined by the postal service in your own country.
Any package being returned to us by the postal service for non-receipt or failure to remove the recipient will be additional charges.
Bricks For Kids can not be held responsible for errors or failure to deliver caused by improper encoding of the delivery address or telephone number of the user control.
The fees charged by Bricks For Kids are fixed and include all taxes for countries belonging to the European Economic Area. For all other countries, charges are exclusive of taxes.
The charges include postage, packaging costs and the costs of preparing the order.
The preparation delay of your order are 1 to 5 working days.
The shipping delay is given on the site as an estimate for each mode of delivery.
d. Delay in delivery
Bricks For Kids makes every effort to ensure that your package arrives as quickly as possible at home. It may exceptionally occur that a parcel arrives late compared to the deadlines given. If the delivery period is more than 7 working days the stated time, the user must inform Bricks For Kids as soon as possible. Bricks For Kids will begin an investigation to locate the package.
If despite all efforts the delivery time is too long for the user, it is always possible to return the package to Bricks For Kids under the conditions set out in Article 7 of these Terms and Conditions regarding returns.
e. Deterioration and loss package
Bricks For Kids takes the greatest care to ensure that each package is packed properly. If nevertheless a product should arrive in poor condition, the user is obliged to accept the package while expressing reservations about the precise delivery note. It is essential to keep a copy of the delivery note on which you have reservations! The user will immediately contact Bricks For Kids or no later than the business day following the delivery of the package to be aware of the procedure.
Any claim not made in the rules defined above and within the time limits could not be taken into account and release Bricks For Kids of all liability towards the consumer.
As for damage for loss of parcel, Bricks For Kids may need information held by the user. The user therefore undertakes to make this information available to Bricks For Kids as soon as possible.
In the case of a loss of packages during transport times may vary investigation carriers and take one to several weeks.
f. Product reference errors
The user must check package contents upon receipt. If errors or quantity of products were inadvertently produced, the user is obliged to inform Bricks For Kids upon receipt or no later than the business day following receipt of the package. Bricks For Kids then assess the merits of the claim and then propose a repair to the user, as described below. If the product is missing, the user will have the choice between reimbursement of the product or its free delivery. In case of error reference Bricks For Kids proceed to exchange the product, the cost of this procedure is the responsibility of Bricks For Kids. No other compensation will be considered.
Art. 7: Order Cancellation and returns
a. Order Cancellation
The user has a period of 14 calendar days after the day following delivery to return its purchase.
If they so wish, he must inform Bricks For Kids via the contact page.
The products concerned will then be returned to Bricks For Kids within 5 days of notification of cancellation.
Only products returned are in their entirety, in their original packaging complete and intact and in perfect condition for resale.
Any product that has been damaged or whose original packaging has been damaged, will not be refunded, returned or exchanged
b. Returns costs
The return shipping costs are the sole responsibility of the user.
Assuming the exercise of the right of withdrawal, the consumer has the option of requesting either a refund of monies paid, or exchange the product.
In the case of an exchange, the return will be at the expense of the user.
b. Returns delivery
No parcel will be returned by the user without first having contacted Bricks For Kids. Any breach of this condition will result in additional costs to be borne by the user.
Bricks For Kids reserves the right to refuse a return if it does not meet the conditions listed above, especially if it is found that the packaging has been opened or damaged obviously by the user.
After acceptance of return notified by email to the user, Bricks For Kids proceed within thirty days after receiving the package refund of returned products.
Art. 8: Protection of personal data
All data requested by the user Bricks For Kids are able to process orders and deliveries. In no case will they be sold or distributed to third parties.
The user has the right to register or to withdraw from the new letter placed at his disposal.
According to the laws on the protection of privacy and personal data, it also has the right to rectify, consultation, modification and deletion of data communicated. This right may be exercised fully online by the user.
Art. 9: Applicable law
These conditions are subject to Belgian law. In case of dispute or claim, the user should first contact Bricks For Kids to get a solution amicably.
Any dispute concerning the sale (price, Terms and Conditions, products, ...) will be subject to Belgian law before the Tribunal de Commerce de Charleroi in whose jurisdiction the headquarters of the seller.
